These Terms & Conditions govern your use of www.monkeyballing.com (“the Site”) and all purchases made through the Site.
By accessing or purchasing from this Site, you agree to be bound by these Terms.

These Terms apply to all users of the Site, including visitors, customers, and buyers.

SCOPE OF PRODUCTS

Monkey Balling offers:

  • Unique one-of-a-kind artworks

  • Limited edition accessories, apparel, and objects

Each product page clearly indicates whether the item is unique or limited edition.

FORMATION OF CONTRACT / ORDER ACCEPTANCE

Your order is considered accepted only after payment is successfully processed and you receive an order confirmation email. We reserve the right to refuse, cancel, or limit quantities for any order at our discretion (e.g. suspected fraud, misuse, incorrect pricing error, inventory mismatch).

Pricing & VAT

  • Prices are listed in EUR and include Belgian VAT, unless otherwise stated.

  • Prices may change at any time; this does not affect confirmed orders.

For international orders, the buyer is responsible for import duties, customs, and taxes where applicable.

SHIPPING

Shipping costs vary depending on region, carrier, weight, and product type. Final shipping costs are always shown at checkout before payment.

Occasionally, promotional free shipping may apply to certain products or certain regions (e.g. EU). When free shipping applies, it will be clearly communicated on the product page prior to purchase.

International shipments may incur import duties, taxes, or customs fees which are the responsibility of the buyer.

​DELIVERY TIMEFRAMES

Delivery timelines displayed on the Site are estimates. Actual delivery times may vary depending on carrier performance, customs processes, and location.

Delays outside our control (customs, carrier failure, strike, force majeure) do not constitute breach.

RETURNS, REFUNDS & RIGHT OF WITHDRAWAL

1.Standard Products (non-unique items)

You may return standard products within 14 days from the date of delivery (EU right of withdrawal), provided that the item is:

  • unused

  • in original condition

  • returned in its original (or equivalent) protective packaging

 

Return shipping is paid by the buyer, unless the item arrived damaged or incorrect.

Refunds are issued after inspection of the returned item.
We refund standard delivery costs (not express upgrades).

2.Unique / One-of-a-Kind Artworks

Under EU law, the 14-day withdrawal right does not apply to:

  • custom-made items

  • clearly personalised items

  • one-of-a-kind pieces

Therefore, unique artworks are non-returnable for change-of-mind.

If a unique artwork arrives damaged in transit, you must contact us within 48 hours with photo/video evidence.
We will repair, replace, or refund depending on availability.

3. Damaged or Incorrect Items 

If your order arrives damaged, defective, or incorrect:

  • notify us within 48 hours

  • include photo/video evidence

If approved, we will:

  • cover return shipping

  • repair / replace / refund the item (depending on availability)

4. Lifetime Repair Program (eligible pieces only)

  • You cover shipping to the studio.

  • We cover shipping back to you.

  • Repairs use reclaimed materials when possible.

This program is an addition to your statutory rights under EU and Belgian law.​

5. Legal Guarantee (EU 2-Year Mandatory Warranty)

All consumers in the EU benefit from a minimum 2-year legal guarantee for items that are defective, faulty, or not as described.

 

This legal guarantee applies regardless of our returns policy or the Lifetime Repair Program.

If you believe your item has a defect covered by the legal guarantee, contact us with details and photos.

6. Exercising the Right of Withdrawal

To exercise the 14-day right of withdrawal (for eligible items), you may send:

  • an email

  • a clear written statement

  • or the EU Model Withdrawal Form

PAYMENTS

We accept multiple payment methods (availability may vary by region):

  • Stripe

  • PayPal

  • Apple Pay / Google Pay (where supported)

Payments are processed by third-party providers who act as independent controllers for payment data.

INTELLECTUAL PROPERTY

All content on the Site - artworks, product designs, text, images, graphics, logos, trademarks, branding, layout - is protected by intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without written permission.

PROHIBITED USE

You may not misuse the Site, including:

  • hacking, scraping, or interfering with functionality

  • fraudulent activity

  • impersonation or misrepresentation

  • reselling products as if you are Monkey Balling or the original artist

LIMITATION OF LIABILITY

To the extent permitted by Belgian law, Monkey Balling is not liable for:

  • indirect, incidental, or consequential damages

  • losses arising from delays outside our control

  • misuse of the Site or products

Nothing in these Terms excludes liability where it cannot legally be excluded.

DATA PROTECTION & PRIVACY

Your personal data is handled according to our Privacy Policy (GDPR compliant).
By using this Site or placing an order, you consent to the processing of your data as described there.

​DISPUTE RESOLUTION (EU REQUIREMENT)

If you are an EU consumer, you may also submit complaints via the EU Online Dispute Resolution Platform: https://consumer-redress.ec.europa.eu/

We are not obliged to take part in ODR procedures but must provide the link by law.

GOVERNING LAW & JURISDICTION

These Terms are governed by Belgian law.
Any disputes shall be brought exclusively before the competent courts of Belgium.

LANGUAGE

If these Terms exist in multiple languages, the English version prevails.

CHANGES TO TERMS

We may update these Terms from time to time. The “Last Updated” date reflects the latest version.
Continued use of the Site after updates constitutes acceptance of the revised Terms.
